Terms of Service

NearByCollab is a directory and introduction service that connects local businesses ("Brands") with independent content creators ("Creators") for paid, barter or UGC (user-generated content) collaborations, starting in Lucknow and expanding to other Indian cities over time.

We do not employ Creators, we are not a party to any agreement a Brand and Creator reach with each other, and we do not currently process payments between Brands and Creators — deals are negotiated and settled directly between the two parties (for example over WhatsApp, UPI or bank transfer) unless we tell you otherwise in writing. NearByCollab is not liable for the outcome, quality, timeliness or payment of any collaboration arranged through the Platform.

You must be at least 18 years old and able to form a binding contract under Indian law to create an account. You are responsible for the accuracy of the information in your profile and for keeping your login credentials secure. One person or business may not maintain more than one account for the same role without our permission.

Creators represent that they own or have the right to share every photo, handle, follower count, engagement figure and other detail they submit, and that their Instagram/YouTube presence genuinely belongs to them. Follower counts, pricing and engagement stats shown on profiles are self-reported by Creators; NearByCollab reviews new profiles before they go live but does not independently audit every statistic.

By publishing a profile you grant NearByCollab a non-exclusive, royalty-free licence to display your name, photo, handle and stated stats on the Platform and in reasonable marketing of the Platform (for example a "featured creators" section), for as long as your profile is live. You can request removal at any time by deleting your profile or contacting us.

A collaboration request sent through the Platform is a brief expression of interest, not a binding contract. Terms of the actual collaboration — deliverables, usage rights, payment, timelines — are for the Brand and Creator to agree upon directly. We strongly encourage both sides to confirm scope and payment in writing (even a simple message thread) before starting work.

NearByCollab does not currently charge Brands or Creators to use the Platform during the launch period, and does not hold or process funds exchanged between Brands and Creators. Any payment or product-barter dispute is between the Brand and the Creator. See our Refund & Cancellation Policy for how we handle any future paid Platform features.

• Impersonating another person or business, or misrepresenting your reach or identity.
• Posting sexually explicit, hateful, harassing, defamatory or unlawful content.
• Using contact details obtained through the Platform to spam, scam or harass anyone.
• Scraping, reselling or bulk-exporting profile data without our written permission.
• Attempting to bypass moderation, verification or account suspensions.

We may suspend or remove any account that violates these Terms, misuses the report/block tools, or is the subject of credible abuse reports.

If a Brand or Creator behaves inappropriately, you can report them from their profile or from a collaboration in your dashboard, and you can block a user to prevent further contact through the Platform. Our team reviews reports and may warn, suspend or permanently remove accounts at our discretion. Reporting does not guarantee a particular outcome or timeline.

The Platform is provided "as is" without warranties of any kind. We do not guarantee that any Creator will accept a request, that any collaboration will be completed, or that any profile statistic is accurate. To the maximum extent permitted by law, NearByCollab and its team are not liable for any indirect, incidental or consequential loss arising from your use of the Platform or from a collaboration you enter into with another user.

You may delete your account at any time. We may suspend or terminate accounts that breach these Terms, pose a risk to other users, or are inactive for an extended period, with or without notice where reasonably necessary to protect the Platform or its users.

These Terms are governed by the laws of India. Courts at Lucknow, Uttar Pradesh have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform.

We may update these Terms as the Platform grows. Material changes will be reflected by updating the "Last updated" date above; continued use of the Platform after a change means you accept the revised Terms.
